What is it like to buy a home in Spain if you are a foreigner: guide to understand the process step by step

Buying a home in Spain is a decision that thousands of foreign citizens make every year. Some seek to establish their residence here, others want to enjoy a second home next to the Mediterranean and there are also those who consider the purchase as a long-term investment.

In areas such as _Málaga _and the_ Costa del Sol_, the presence of the international buyer has been part of the reality of the real estate market for years. However, when facing an operation from another country, it is normal for many questions to arise: can I buy without being a resident? Do I need a NIE? How can I check that the home is free of charges? What happens if I cannot travel to carry out all the procedures?

The Spanish system offers different mechanisms to provide legal security to the sale. Understanding how each stage works allows you to face the operation with much more peace of mind.

Can a foreigner buy a home in Spain? Yes. Being a foreigner or not habitually residing in Spain does not generally prevent you from acquiring real estate property in our country.

Therefore, someone who currently lives in the United Kingdom, Germany, Belgium, the Netherlands, France or any other country can buy a home in Spain even if their habitual residence continues to be outside Spanish territory.

The important issue is not so much the possibility of buying as correctly preparing the operation and complying with the corresponding administrative, fiscal and legal procedures.

The NIE: one of the first procedures

One of the concepts that quickly appear when a foreign buyer begins to inform himself is the Foreigner Identity Number, commonly known as NIE.

The Ministry of the Interior explains that it is a personal, unique and exclusive number that identifies the foreigner in those documents and procedures related to their economic, professional or social interests in Spain.

It can be obtained in Spain and there are also procedures to request it from abroad. It is advisable to start this process well in advance so that the administrative documentation does not end up delaying an operation that is already advanced.

Before buying, you have to know exactly what you are buying.

Finding a home that fits our needs is just the beginning.

Before committing a significant amount of money, it is essential to check the legal status of the property. One of the essential tools to do this is the information provided by the Property Registry.

Through a simple note you can know the identification of the property, who appears as the owner and what rights or charges are registered on it, such as a mortgage, usufruct or certain limitations.

For a buyer who lives hundreds or thousands of kilometers away, this check becomes even more important. The home that appears in photographs must coincide with a legal reality that should also be known before moving forward.

Reservation, deposit contract and negotiation

Once the property has been located and the appropriate checks have been carried out, a particularly important stage begins: agreeing on the conditions of the purchase.

In Spain, it is common that before granting the public deed, private documents are formalized that establish the commitments assumed by the buyer and seller. Among them is the well-known earnest money contract.

Here it is advisable to avoid rushing. Giving an amount of money or signing a document can generate legal obligations and consequences. For this reason, the General Council of Notaries recommends obtaining adequate information before signing any document or making payments of money related to the acquisition.

For a foreign buyer, fully understanding what they are signing is especially important. If there is a language barrier, you should also ensure that you understand the content and scope of each commitment before accepting it.

Do you have to be physically in Spain during the entire process?

This is one of the most common doubts and also one of the questions that can bring the most peace of mind to the international buyer. You will not necessarily have to travel to personally carry out each procedure.

The College of Registrars itself contemplates in its guide for foreign buyers the possibility of using powers for certain actions within the process. This can be especially useful when the buyer resides outside of Spain and needs a duly authorized person to carry out arrangements on their behalf.

Each operation must be analyzed individually and the power of attorney must be correctly prepared for the actions that you want to delegate.

The signature before a notary

The public deed represents one of the central moments of the sale.

The notary exercises an essential function of controlling legality and legal security. Among other checks, it verifies the identity and capacity of the parties, examines the documentation provided and the situation of the property and provides information on the obligations derived from the operation.

For a foreign buyer, this figure provides an especially important layer of security within a legal system that they probably do not know in the same depth as that of their country of origin.

The General Council of Notaries precisely advises foreign citizens to seek notarial advice when they are considering purchasing a property in Spain.

Taxes and expenses must also be part of the budget

The advertised price of a home does not represent the total cost of the operation.

The purchase generates taxes and other associated expenses that must be calculated before making a decision. Its amount will depend, among other factors, on whether a new or used home is purchased, the autonomous community where it is located and the specific circumstances of the operation.

There may also be notarial, registration, financing or advisory costs.

Therefore, before setting the maximum budget for housing, it is advisable to calculate the overall cost of the acquisition and reserve sufficient margin for these items.

In an international purchase, planning this part from the beginning avoids encountering expenses that had not been taken into account when a commitment has already been made with the seller.

Can a foreigner apply for a mortgage in Spain?

Being a foreigner does not necessarily mean having to buy in cash either.

Spanish financial institutions can grant financing to foreign buyers, including non-residents, although the conditions, the percentage financed and the required documentation will depend on the entity and the economic profile of the applicant.

If the purchase depends on financing, it is advisable to study this issue before definitively committing to a home. Knowing in advance the real financing capacity allows you to search within an adequate budget and negotiate with greater security.

After the signing there is still an important step

Handing over the keys is probably the most exciting moment, but legally there is still a particularly relevant procedure: the registration of the new ownership in the Property Registry.

The College of Registrars highlights that registration provides the buyer with protection over the acquired right and against certain subsequent charges or rights.

Once the operation is registered, the home will be registered in the name of the new owner.

It is the last big step in a journey that began much earlier, probably when that foreign buyer began to imagine what it would be like to have a house in Spain.

Buying from another country requires more than just finding a home

When someone is looking for a house in a country they don't know in depth, the questions are rarely limited to how many bedrooms they need or what views they prefer.

You also want to know where it is best for you to live, which municipalities are active throughout the year, what the communications are like, what services you will have nearby and what differences exist between some areas and others.

On the Eastern Costa del Sol this issue is especially relevant. Benajarafe offers a very different lifestyle from Torre del Mar or Rincón de la Victoria, in the same way that a home by the sea responds to different needs from a property located in the interior of Axarquía.

Therefore, good real estate support should begin by understanding what that person is really looking for and why they want to buy.

Distance should not become uncertainty

Buying a home in Spain while living in another country can seem complex when you look at the entire process at once. In practice, the key is to proceed in stages, properly check the property and have the right professionals for each part of the operation.

The buyer must be able to understand what is happening, what they are signing, what their costs will be and what the next step is.

And when that information exists, distance is no longer the main problem.
